Tom Petty has earned a writing credit for Sam Smith’s Stay With Me

Sometimes it pays to stand your ground. Singer-songwriter Tom Petty will now have a writing credit on Sam Smith’s hit single Stay With Me by proving its similarity to Petty’s 1989 hit I Won’t Back Down.

The Boston Herald reported Petty’s representative’s announcement on Monday January 26. Petty had noticed that Stay With Me, written by Sam Smith, James Napier, and William Phillips, bore close similarities to his song, co-written with Jeff Lynne. Lynne and Petty contacted Stay With Me’s publishers to address the situation.

Smith’s rep spoke with Rolling Stone Magazine, confirming the alleged similarities were “heard in the melodies of the choruses of the two compositions.” Smith, Napier, and Philips reported they had never heard Petty’s song but after playing it “acknowledged the similarity,” which they called “a complete coincidence.” After this realization, there was an “immediate and amicable agreement” among all parties giving Petty and Lynne co-writing credit.

Stay With Me was a bona fide hit in 2014, selling more than 3.5 million copies. It has also been nominated for record and song of the year at the upcoming Grammys in February.

Despite now being “co-writers,” Petty and Lynne will not be considered “co-winners” should the song take home any awards.   According to Rolling Stone, Senior Vice President of Awards Bill Freimuth has reported that since the I Won’t Back Down scribes “did not do any new writing” for Stay With Me, they would not share any Grammy awards.

Neither Smith or Petty have commented personally on the decision.
