Idaho's same-sex marriage ban is ruled unconstitutional; Governor rips ruling

The judge's order takes effect on Friday.

According to a report from CNN, a judge has declared Idaho’s ban on gay marriage to be unconstitutional.

“Idaho’s marriage laws deny its gay and lesbian citizens the fundamental right to marry and relegate their families to a stigmatized, second-class status without sufficient reason for doing so,” U.S. Magistrate Judge Candy Wagahoff Dale wrote on Tuesday. “These laws do not withstand any applicable level of constitutional scrutiny.”

While many celebrated the fact that Idaho is one of a growing number of state where bans on same-sex marriages have been ruled unconstitutional, not everyone was thrilled with the decision, including the state’s governor.

“In 2006, the people of Idaho exercised their fundamental right, reaffirming that marriage is the union of a man and a woman,” Governor C.L. “Butch” Otter said in a statement obtained by The Associated Press. “Today’s decision, while disappointing, is a small setback in a long-term battle that will end at the U.S. Supreme Court.”

According to The AP, bans on same-sex marriages have recently been ruled unconstitutional in Arkansas, Virginia, Oklahoma, Michigan, Texas and Utah.
