The bitter custody battle between comedienne Rosie O’Donnell and her soon-to-be ex wife Michelle Rounds just got uglier.
Rounds, 43, after announcing their split in February – believes O’Donnell, 53, is an unfit parent to their adoptive daughter Dakota, 2, because of her “excessive use of booze and weed,” TMZ reported.
“My client Michelle Rounds has decided to start proceedings for sole custody of their daughter Dakota, since it is unequivocally in their child’s best interest and general welfare,’’ an attorney for Rounds told the Daily Mail.
The former couple — who have a prenuptial agreement — married in June 2012 and adopted Dakota the following year. Rounds said she and O’Donnell clashed in their parenting styles, which contributed to their split.
They officially split just two weeks after the TV star quit The View to focus on her family and health.
They were separated for a few months before filing for divorce in February, citing “an irretrievably broken relationship.” O’Donnell and Rounds met in the summer of 2011 at a Starbucks.
“This (legal proceedings) is an absurd and desperate attempt to use a child for her [Rounds’] own gain,” a spokesperson for O’Donnell told the Daily Mail.

It was also alleged that in those papers, Rounds has stated the former “The View’ host let their 19-year-old son ‘throw parties where the kids all drink, which she believes is irresponsible.”
“I just want my child (Dakota) to have the best possible environment to grow up in, a normal life,” Rounds told Entertainment Tonight. “Right now she’s got 24/7 nannies over there at Rosie’s house. I don’t want my child to have a 24/7 nanny.”’
The Daily Mail reported that Rounds made it clear that she is not after O’Donnell’s money saying “I’ll walk away from the prenup if she gives me full custody.”
“I made my first million before the age of 39, that was before I met Rosie,” she added. “I don’t need Rosie’s money. Nothing was in my name.”
O’Donnell has yet to publicly comment, though she recently Instagrammed a photo on Tuesday of Dakota with her hand in the air, captioned, ‘excuse me – do i get a vote?’
In response to the photo, Rounds said: ‘At two-and-a-half-years old, I’m not quite sure a child should be asked those questions.
O’Donnell was married to her first wife, Kelli Carpenter, a former Nickelodeon marketing executive, in 2004.
They got married in San Francisco just after San Francisco Mayor Gavin Newsom ordered that marriage licenses be granted to same-sex couples.
O’Donnell and Carpenter, who split in 2007, were raising four children together – Parker, 19, Chelsea, 17, Blake, 15, and Vivienne, 12.
O’Donnell adopted Parker and Chelsea prior to meeting Carpenter. Together they adopted Blake, while Vivienne was born to Carpenter via artificial insemination.
And it appears Rounds has already moved on.
She was seen with Carmen Ortega, who used to date Kim Kardashian’s ex Reggie Bush, at trendy Japanese restaurant Katsuya in Hollywood, the Daily Mail reported.
Ortega was wearing a very revealing black tank top and skintight jeans with heels.
Rounds was more covered up in an over-sized white blouse, though she showed off her toned legs in skinny jeans.
Rounds was also seen leaving Madera, a Los Angeles restaurant, hand-in-hand with Ortega. They left in the same car, the Daily Mail reported.
Earlier in the day, Ortega was seen at Starbucks in Studio City, the newspaper reported, was wearing a dark beige sheer dress, the same type Kim Kardashian, and 34, and wore in June 2014.
With her long brunette locks worn down, dark shades and gladiator style sandals, she looked like a dead ringer for the E! star, the Daily Mail reported.
