The late lead singer's father seeks $1 million in damages from remaining band members and management.
GWAR is being sued by their late lead singer Dave Brockie’s father. NBC News reports that Brokie’s father, William Brockie, is suing the band for $1 million in damages and unpaid earnings and the withholding of his son’s ashes.
Dave Brokie, better know by stage name Oderus Urungus, was the lead singer of science fiction metal band GWAR until his death last year from a heroin overdose.
The suit states that “immediately after Dave Brockie’s death, the remaining active members of GWAR … set out on a course of action to capitalize on the death of Dave Brockie.”
It goes on to say that the remaining band members and their management company Slave Pit Inc. owe the Brockie family compensation for the last tour in which Brockie participated, along with several personal effects and most disturbingly—Brockie’s ashes.
According to the suit, when William Brockie went to retrieve his son’s ashes he was denied access to Slave Pit headquarters. After persisting, the ashes were “delivered in a used plastic bag” to Brockie Sr.
GWAR has responded to the accusations, denying the claims the lawsuit made.
“We did not steal Dave Brockie’s ashes, or anything else that belonged to him,” the band stated. “In fact, all of the items mentioned in the article, including Dave’s ashes have been available to his attorneys for weeks.”
The band maintains that they have done their best to uphold what they believe would be Dave’s wishes would be.
“Dave Brockie was our friend, peer, co-worker, and our family,” the band wrote. “We trust our fans will see through this, and we will be able to get back to work on the one thing we all know Dave Brockie loved; GWAR.”
