Singer/actress and former Disney Channel mainstay Hilary Duff has reportedly filed for divorce from her husband Mike Comrie after nearly five years of marriage.

TMZ reports that Duff started divorce proceedings after rumors surfaced of Comrie enjoying a crazy night out in Beverly Hills at a restaurant with pals. Apparently the over-served hockey star was propositioning women right and left, which was the last straw for his wife.

Hilary has retained attorney Laura Wasser and cites the reason for the split as “irreconcilable differences.” Although news of their separation went public in January 2014, the date of separation on the actual filing is listed as January 2013.

When their split was confirmed, a representative for Duff insisted that she and Comrie would share parent duties equally.

“They remain best friends and will continue to be in each other’s lives,” Duff’s rep claimed in a statement to People Magazine in January 2015. “They are dedicated to loving and parenting their amazing son [3-year-old-Luca], and ask for privacy at this time.”

Despite their difficulties, Duff and Comrie have remained friendly, leading to rumors of a reconciliation, and the pair were spotted with clasped hands as they departed a 2014 Halloween party in LA. However, there was never a confirmation of their reconnecting.

Duff has kept relatively mum on social media with respect to the situation between her and Comrie. On Valentine’s Day, the actress posted a humorous shot of little Luca with a bag over his head, captioned, “My Valentine is a weirdo.”

The actress is seeking primary custody of the couple’s son, citing concerns that his excessive partying could have negative ramifications for their child.
