DA states statute of limitations in the 40 year old allegation was only three years
The Los Angeles city District Attorney’s office announced Tuesday, they will not be filing charges in the Rape investigation involving comedian Bill Cosby. LAPD Detectives opened the investigation after a complaint was filed by Judy Huth earlier this month.
Los Angeles D.A.’s prosecutor’s office released a statement outlining the 40-year-old case, as far past the statute of limitations. They pointed out, the statute of limitations when the alleged attack occurred was three years. “Therefore, prosecution today for any potential felony sex crime from 1974 would also be barred,” the D.A. said in a court document. According to the document the law back then would have only made this crime a misdemeanor.
Huth also has filed a civil lawsuit in Los Angeles Superior Court. In the civil lawsuit, Huth said she and a 16-year-old friend met Cosby when she was 15 years old at a park in San Marino, Ca., a suburb of Pasadena. The alleged assault occurred later that day at the Playboy mansion, Huth alleges Cosby gave her alcohol to drink and led her to the mansion then allegedly raped her in an upstairs bedroom.
The announcement comes just days after Cosby’s wife broke her silence to defend her husband of 50 years. Camille Cosby released a statement where she criticized media coverage of the multiple allegations against her husband.
“There appears to be no vetting of my husband’s accusers before stories are published or read,” Cosby statement read. “An accusation is published, and immediately goes viral.” She added, “The man I met, and fell in love with, and whom I continue to love, is the man you all knew through his work. He is a kind man, a generous man, a funny man, and a wonderful husband, father and friend. He is the man you thought you knew.”
On Tuesday, Today show co-anchor Kathy Lee Gifford revealed on the air, that back in 1975, when she was touring as the opening act for Cosby, he allegedly tried to kiss Gifford. “I will admit, towards the very last times I saw him, he did try to kiss me, I said, ‘Bill, no, we’re friends,’ and he said, ‘OK, goodnight,’ and I said, ‘Goodnight.’ And I went to my room, and he went into his room.”
In 1997, Autumn Jackson made public claims she was Cosby’s illegitimate daughter, after she learned in 1975 her then 23 year old mother, Shawn Upshaw, had an affair with the comedian. Jackson was later convicted by a Manhattan jury of trying to extort Cosby.
However, Cosby reportedly said in an interview years later, he’d enjoyed the “rendezvous’’ with Jackson’s mother. Cosby reportedly added he was, “at best, a lousy husband and, at worst, a rank hypocrite,” he later admitted that he paid the mother and daughter more than $100,000 over the years and also set up a trust fund for Jackson. Records indicate Cosby paid $25,000 to cover Jackson’s tuition and expenses at a Florida community college in 1994-95.
In 2006, Cosby settled a civil lawsuit with a woman who claimed Cosby drugged and sexually assaulted her outside his Philadelphia home. As part of the settlement, the dollar amount will remain confidential.
