Five New York City Mothers Sue the City Over Its Flu Vaccine Mandate

Mothers in NYC have banded together to sue the city over the mandated flu vaccination. They say that they know what's best for their children, not the government.

A small but determined group of five mothers in New York City have sued the city to get an injunction against having their children receive the flu vaccine. The are furious that an unelected bureaucrat from the city’s health department mandated that all children in the city between the ages of 6 months and 5 years must receive a flu shot or they can’t attend any city day care centers or pre-schools.

Under this independently ordered mandate, those responsible for children who don’t get them vaccinated with the flu shot by Dec. 31 will face fines of $2000, and their children will be expelled from whatever situation the are currently in, according to the New York Daily News. The mothers state that they are willing to go along but the flu vaccine had not been officially mandated by the city but just by some obscure health official.

Their attorney has said that the state is violating a fundamental right to privacy and that a flu shot can’t be somehow undone after it has been administered. The mothers believe that they should be allowed to exert their informed consent about what is going into their child’s body. They are responsible for their children, they assert, not the state.

The mothers also state that there is now a “slippery slope” if the city of elected officials are going to allow and unelected bureaucrat dictate policy and create law out of thin air. The mothers also declare that it simply isn’t fair that their children should be denied the academic and social development advantages of day care and pre-school.

The mothers are concerned that the flu shot is not safe and will not allow their children to be vaccinated. Their children are being denied the opportunity to attend the schools of their mother’s choosing and the mothers feel they have no recourse but to bring the matter to a head in a court of law.
