Mistrial declared in case of white cop who shot unarmed black man

Confusion reigns as North Carolina judge ends the courtroom drama on Friday with a mistrial.

A North Carolina judge has declared a mistrial in the case of a white police officer who faces voluntary manslaughter charges after the death of an unarmed black man.

Judge Robert Ervin declared it after four days of deliberations when the jury was unable to come to a consensus decision, with its vote at 8-4 and no indications that anything would change or which side that vote was leaning toward, according to an Associated Press report. The case involved Charlotte-Mecklenburg Police officer Randall Kerrick, who is accused of shooting to death Jonathan Ferrell.

It took 19 grueling hours to come to that point, as jurors weren’t able to come to a consensus on the issue. Prosecutors asked Ervin to let them keep deliberating.

Meanwhile, protesters were outside the courthouse, laying down in the middle of the streets to protest the shooting, chanting “no justice no peace” at the family of Kerrick, and later “hands up don’t shoot.”

Kerrick faces up to 11 years in prison if convicted — that is, if he is retried at all. Prosecutors will review the case and see if they should pursue it further.

Prosecutors argue that non-lethal means would have been more than enough to subdue Ferrell, a Florida A&M football player, back in September of 2013, as two officers who were with Kerrick at the time did not fire their guns. But Kerrick’s attorneys have argued that he feared for his life when he pulled the trigger, which resulted in the death of Ferrell. Police were responding to a call of breaking and entering.

Police say that on that fateful day, Ferrell crashed his car and went to a nearby house, banging on the door to seek help. Instead, the resident called the police, prompting three officers to respond. One of the officers deployed a Taser, which Ferrell did not respond to, and Kerrick then fired 12 shots, 10 of which hit his victim, according to the report.
