Montana homeowner convicted of gunning down German teen faces sentencing

Markus Kaarma attempted to use the state's "castle doctrine" law to defend himself, but prosecutors argued that he practically lured the victim into the garage and never felt in any danger.

A Montana homeowner who was convicted of killing an unarmed Germany exchange student who walked into his garage will be sentenced today.

Markus Kaarma, the homeowner, was convicted of gunning down 17-year-old Diren Dede of Hamburg back in December. He defended his actions under Montana’s “castle doctrine” law — which allows homeowners to use deadly force against home invaders in cases where the homeowner believes he or she is in danger — but failed to convince the jury, which found him guilty in December, according to a Reuters report.

The defense requested a new trial last month before sentencing on the grounds that media coverage was “prejudicial” and “inflammatory,” making an impartial jury impossible.

Prosecutors portrayed Kaarma, 30, as the aggressor in the situation who went so far as to lure Dede to his house in order to kill him as the student was “garage hopping” in Missoula possibly searching for alcohol, according to the report.

Kaarma had installed motion detectors and a monitor just days before the shooting and even left a purse filled with cash in the garage on the day he was killed, prosecutors argued.

They also said that Kaarma did not fall under the castle doctrine because he left his house to go into the garage and corner Dede after hearing the monitoring devices go off.

Prosecutors further alleged that Kaarma probably didn’t consider himself in any danger as that he had repositioned himself to take a final, fatal shot even after incapacitating Dede with the first shot, according to ballistics evidence.

Kaarma’s defense team, meanwhile, said that he had no obligation to retreat, and he had a write to confront Dede. They are asking for the verdict to downgraded to mitigated deliberate homicide.

Kaarma faced 100 years in prison.
