The lawyers representing Boston Marathon bombing suspect Dzhokhar Tsarnaev are trying to delay the trial in order to buy more time to prepare for it.

Tsarnaev faces the death penalty for the April 15, 2013 bombing of the marathon’s finish line, which killed three people and caused injuries to 260 others. He had pleaded not guilty to the charges, according to CBS News.

Jury selection is set for Jan. 5, but the defense wants to delay the trial all the way until September in order to ensure a “fair trial,” the defense lawyers wrote in their filing. The defense argued that most defendants in federal capital cases get more time to prepare.

About 19,000 pages of documents in addition to spreadsheets and audio files were submitted, which is reason alone for delaying the trial, the defense argued. Also, prosecutors have not turned over documentation they have requested, including evidence that would support the allegation that Tsarnaev’s older brother, Tamerlan, had a heavy influence on him. Tamerlan Tsarnaev was killed in a shootout with police days after the bombing.

Prosecutors, however, say they have turned over all the evidence they are required to submit.

The defense team continued their bid to move the trial outside of Massachusetts, arguing that media coverage surrounding the case would prevent them him from getting a fair trial in the state. They pointed to an Associated Press story that recently listed the event as the top news story of 2014 for the state of Massachusetts.

The defense team had previously tried to push the trial to the fall, but a judge denied that request and instead allowed a two-month delay to January. He has yet to rule on whether to allow a new delay, or if the trial should be moved elsewhere.
