
Milwaukee Police Chief Edward Flynn did not find any malice in Manney's actions.
The Associated Press reports that 38-year-old Christopher Manney, a law enforcement officer in The Milwaukee Police Department, has been fired after fatally shooting a mentally ill man on April 30, 2014.
“Based on the totality of the circumstances, including the aggravating and mitigating factors I’ve described, I signed an order terminating Christopher Manney from his employment with the Milwaukee Police Department earlier today,” Milwaukee Police Chief Edward Flynn said in a statement, obtained by fox6now.com, on Wednesday.
According to Flynn’s statement, Manney went to Red Arrow Park to check on the welfare of 31-year-old Dontre Hamilton, not knowing that two officers had already checked on the man’s welfare earlier in the day. Manney found Hamilton lying on the sidewalk and asked him to stand up so he could conduct a pat down. As Manney started the search, Hamilton started fighting with Manney. As the confrontation grew increasingly violent, including punches and strikes from both parties, Manney tried to use his baton to stop Hamilton, but the 31 year old was able to take the baton from the police officer. After being struck several times, Manney turned to his gun and fired at Hamilton multiple times. Hamilton died of his wounds.
Although Flynn did not find any malice in Manney’s actions, he said that Manney accurately identified Hamilton as an Emotionally Disturbed Person. However, Manney treated Hamilton as a dangerous criminal instead of following his training and treating Hamilton as an EDP.
“Manney’s approach, including an out-of-policy pat down, was not based on individualized reasonable suspicion but on an assumption of his mental state and housing status,” Flynn added. “This intentional action, in violation of training and policy, instigated a physical confrontation that resulted in a deadly use of force.”
According to 9&10 News, some are comparing this police-involved shooting to the shooting death of the unarmed teen in Ferguson, Missouri.
