The women are suing the sperm bank after being impregnated by sperm from a black donor when they had chosen a white donor.
An Ohio couple are suing a Chicago based sperm bank after one of the women became pregnant with sperm from a donor other than the one she and her partner had chosen.
Jennifer Cramblett found out about the mistake after she was five months pregnant with her child. She and her partner, Amanda Zinkon, had chosen a white donor but the sperm bank had given her sperm from a black donor instead. They discovered this error when trying to reserve sperm from the same man for their next child.
The sperm bank in question is called Midwest Sperm Bank and is located in Cook County, Illinois. So far, no statement has been released from the sperm bank. There is not even information regarding who their lawyer might be.
The lawsuit states that the women had relocated to Uniontown during their pregnancy to be closer to family. They now live in a predominantly white neighborhood and among a family that is “all-white, and often unconsciously insensitive.” Cramblett states that identifying as a lesbian has exposed her to enough prejudice to be concerned for what her two-year-old daughter might face in her life.
The lawsuit also alleges that there are no controls within the sperm bank to ensure accidents like this do not occur again. Record keeping is also alleged to be inadequate.
Cramblett and Zinkon are seeking $50,000 in damages, in part to cover the costs of continued therapy. Cramblett states that their intention for suing is to prevent this type of incident from happening to others.
According to the lawsuit, recommendations from their therapy have been to relocate to a neighborhood that is more diverse.
Both women express their undying love for their daughter, whom they claim they would not change one bit. They say that the purpose of the lawsuit is prevention and protection for others seeking insemination.
