Walmart: Tracy Morgan should have worn a seat belt

Actor and comedian Tracy Morgan is suing retail giant Walmart for injuries he sustained when a Walmart tractor-trailer rear-ended his limousine. The incident occurred on the New Jersey Turnpike earlier this year.

Attorneys for the company have responded, claiming Morgan is the one at fault, all because he wasn’t wearing his seat belt.

According to legal documents filed in the case, the company says they are not liable for the broken leg and broken ribs Morgan sustained in the crash on the night of June 7. They have denied any responsibility for the accident and discount Morgan’s claims that the incident occurred as a result of their negligence as “bogus”.

“Upon information and belief, plaintiffs’ injuries, if any, were caused, in whole or in part, by plaintiffs’ failure to properly wear an appropriate available seatbelt restraint device,” said Wal-Mart attorneys in court papers.

They continue to deny any wrong-doing in the matter, as the court filing insists that the actor failed to exercise ordinary care in making use of available seatbelts … and acted unreasonably and in disregard of plaintiffs’ own best interests.”

State law in New Jersey requires anyone riding in or operating a motor vehicle to wear a seatbelt.

The company also went on to state that they should not be responsible for any punitive damages in the matter.

As for the driver in the crash, Kevin Roper, the company refuses to confirm that he was even an employee at the time and they refuse to discuss anything related to him, because there is still an “ongoing investigation” related to the accident.

Roper has since pleaded not guilty in charges brought against him, but authorities have previously stated the driver had not slept for over 24 hours prior to the incident.

Morgan, along with fellow passengers Ardley Fuqua and Jeffrey and Krista Millea, are all named as plaintiffs in the action and are seeking damages from the accident, which left Morgan and others badly injured and resulted in the death of Morgan’s friend Jimmy Mack.
