Musician tells Disney to "lawyer up" if they want to stop him from trademarking his logo.
Electronic musician deadmau5 applied to have his signature logo trademarked by the US Patent and Trademark Office in Jun. 2013, but Disney filed a 171-page “trademark opposition proceeding” against his application under claims that the logo bares too much of a similarity to Mickey Mouse. The Canadian musician is now ready to face off with the entertainment powerhouse in court, vowing he won’t be “bullied.”
“Lawyer up Mickey. Disney thinks you might confuse an established electronic musician / performer with a cartoon mouse. That’s how stupid they think you are,” wrote the musician on his official Twitter account, which is followed by over three million fans.
The logo in question features a front-facing mouse with large circular ears. He has been wearing the signature mouse head for over 10 years, and it is trademarked in 30 countries, including Germany, Japan, Italy and the U.K.
“The deadmau5 front-facing mau5head is a registered trademark in 30 countries worldwide … Disney is now opposing the US filing,” said deadmau5’s lawyer Dina LaPolt. “Given that the mau5head and other identifying deadmau5 trademarks have been used in the US and around the world for almost a decade, we wonder why Disney is only now coming after deadmau5.”
“Our client will not be bullied by Disney and is prepared to fight to protect his rights to his property.”
Disney has not yet issued a statement confirming or explaining their attempt to block deadmau5’s trademark application.
