Tracy Morgan still struggling to recover from accident, says attorney

The comic continues on his long road to recovery.

Comedian and actor Tracy Morgan is still struggling to recover from a six-car wreck that occurred on June 7, according to his attorney.

Morgan, 45, was traveling in a limousine on the New Jersey Turnpike when the vehicle he was in was struck from behind by a Wal-Mart semi driven by Kevin Roper.

The 30 Rock star suffered broken ribs, nose and leg in the crash. His friend, fellow comedian James McNair, died in the crash. Two other friends were critically injured. The group had been traveling together following a performance at a Delaware casino.

“The interesting thing is that at the beginning, the Internet was saying that (Morgan) was dead,” commented Morgan’s lawyer, Benedict P. Morelli, in an interview with Today host Matt Lauer on Monday. “And then they said they amputated his leg. Now it’s coming out that he’s doing great. None of those things are true or accurate.”

After the crash, Morgan was hospitalized in critical condition. He spent two more weeks in the hospital before returning home. The comic was spotted exiting the hospital with the assistance of a walker. He flashed a “peace” sign to onlookers and told the paparazzi who had gathered there that he felt “strong.”

Apparently, this isn’t always the case. According to his attorney, Morgan’s recovery is proving more difficult than media outlets have been portraying.

“He’s still struggling,” noted Morelli. “But he’s a fighter.”

Wal-Mart truck driver Roper has been charged with one count of death by auto and four counts of assault by auto. He has pled not guilty to all of the charges.

Morgan, and others who suffered as a result of the accident, have filed a civil lawsuit against Wal-Mart, claiming that the giant retail chain acted negligently. The suit claims that Wal-Mart should have been aware that the driver had been up for more than 24 hours prior to the accident.

Morelli states that illegally long hours are common at Wal-Mart.

“I’m going to show if I have to in court that that’s the culture (at Wal-Mart),” Morelli told Lauer. “That’s what they set up. They know. … They have to make sure that this doesn’t happen.”

In addition, Tracy Morgan’s attorney noted that despite the actor’s current struggle, “He’s had issues before that he’s fought through, and he’s fighting hard.”
