Web series creators are suing those involved with the 2012 hit comedy 'Ted' for stealing 'Charlie the Abusive Teddy Bear' concept.
Seth MacFarlane’s 2012 raunchy, R-rated comedy Ted earned an impressive $549 million worldwide, and MacFarlane revealed via his Twitter on Wednesday that he’s been hard at work on the sequel. However, plans for Ted 2 may soon get delayed, as the creators of the Charlie the Abusive Teddy Bear web series are suing MacFarlane, production company Fuzzy Door Productions, and Ted distributor Universal Pictures for creating an “unlawful copy” of their character.
Charlie the Abusive Teddy Bear revolves around a “generally vulgar yet humorous” teddy bear with a “penchant for drinking, smoking, and prostitutes.” The web series, which launched in 2009, is available on YouTube and Funny or Die. Several videos from the series have reached nearly 10,000 views.
Bengal Mangle Productions filed the lawsuit in U.S. District Court in Los Angeles on Tuesday, claiming that the two teddy bear characters are similar enough to constitute a violation of their copyright.
“Charlie and Ted have displayed consistent, widely identifiable traits that make this vulgar teddy bear especially distinctive,” the suit claims. “Charlie and Ted each have a substantially similar persona, verbal tone, verbal delivery, dialogue and attitude. Both Charlie and Ted reside in a substantially similar environment, including that both Charlie and Ted spend a significant amount of time sitting on a living room couch with a beer and/or cigarette in hand.”
Among the comparisons noted in the suit is the social media activity of the two characters. “I drink on Tuesday night to celebrate the fact that it ain’t Monday night,” read a April 4, 2012 tweet “Ted” posted to his Twitter account in the film. Bengal Mangle Productions explains in the case that this is oddly similar to “Charlie’s” May 9, 2009 tweet, “I have a life mission and it is to drink.”
The lawsuit is seeking unspecified damages.
A spokesman for Universal Pictures has declined to comment on the suit, and The Times has reached out to MacFarlane’s representative for comment. As of now, the release date for Ted 2 remains on June 26, 2015.
