Judge reversed previous ruling on Tuesday, upholds daughter’s conservatorship.
The bitter battle over the final days of Casey Kasem keeps getting more heated, as the wife of the American Top 40 host fights his eldest daughter for control of his care. On Tuesday, the judge overseeing the Kasem case ruled that he could be taken off feeding and fluid tubes.
This decision, which reversed a previous ruling, also upheld the conservatorship that had been granted to the ailing 82-year-old’s eldest daughter Kerri Kasem. This ruing infuriated Kasem’s wife of 32 years, Jean Kasem, who angrily hurried out of the courtroom after hearing the decision.
“You have blood on your hands,” said Jean Kasem. Her lawyer Steve Haney added, “You just imposed a death sentence.”
This is just the latest chapter in an ongoing drama that began when the radio icon was diagnosed with Lewy Body Disease, a form of dementia that over time destroys the ability of the patient to walk and talk. Second wife, Jean Kasem and daughter, Kerri Kasem have been in constant conflict over how to handle the deteriorating condition of the beloved TV actor and host.
Judge Daniel S. Murphy stated that Jean Kasem failed to act “in the best interests” of her husband when she moved him from a skilled nursing home in California to a private residence in Washington on May 7. This was done against doctors’ orders.
Medical records from a Seattle hospital report that Kasem had suffered painful complications and was not responding to artificial nutrition or fluids. “It would be acutely harmful for Mr. Kasem to have nutrition and hydration restored at this time,” said the judge. “This was at the advisement of doctors at St. Anthony’s.”
As Kasem lies dying, his wife and daughter continue to battle over his care. According to Jean Kasem, “(Kerri) has had in her possession her father less than a week and decided to stop all medication and kill him.” Troy Martin, Kerri Kasem’s lawyer, disagreed. “Nobody wants Mr. Kasem to die. This is without question the most difficult thing I have ever had to do and Kerri has had to do.”
“This is very, very heart-wrenching,” said Martin. “(Mr. Kasem) is receiving morphine drips. Hydration might be a terrible way to die, but he’s receiving medication to keep him comfortable.”
Kerri Kasem explained the situation to the New York Daily News: “We have tried everything to keep him alive. We did put him back on fluids, but we had to take him off again because his lungs were filling up. It sounded like he was drowning. It was excruciating to watch.”
“The feeding was backing up because he can’t digest. This is breaking my heart. We’re been trying for nine days to keep him alive. There’s nothing we want more than for our dad to be here with us.”
For now, Kerri Kasem is calling the shots on how her father will spend his last days, but it seems unlikely that Jean Kasem will give up without a fight.
