Nike giving away 25 dollar gift card to settle FuelBand lawsuit

Nike and Apple are giving away 25 dollar gift card to avoid a lawsuit.

Nike Inc. and Apple Inc. have partnered to settle a class action lawsuit by potentially giving owners a $25 gift card or a $15 check told by a website conceived by Gilardi and Co., a class action claims administrator. (International Business Times report).

The settlement applies to consumers in the United States who purchased the Nike and FuelBand between Jan. 19 2012, and June 17, 2015. Claims can be submitted through the website, on the filing page. 

Plaintiffs accused Nike and Apple violated consumer protection laws by false advertising, specifically the FuelBand’s purported ability to accurately track calorie count, steps and NikeFule points. Additionally, plaintiffs alleged that both franchises didn’t meet their warranty assertions. Both companies deny the claims and maintain they followed legal protocol. Both parties settled the dispute to avoid the expense and inconvenience of drawn-out litigation.

Consumers that wish to remove themselves from the settlement are instructed to do so by Sept. 22. Final consent of the claim is due Nov. 4, and the deadline to file is Jan. 4, 2016.

Despite the avoided litigation, a report from Cnet last year reveals that Apple and Nike might discontinue it to focus on software development. FuelBand was among a niche of related fitness bands Apple refrained from selling in its retail markets to make room for the novel Apple Watch. But nonwristworn trackers are still available for purchase both online and in retail locations.
